Effective Date: January 1st, 2014.
This User Agreement ("Agreement") is a contract between you and Coincove and applies to your use of Coincove services. You must read, agree with and accept all of the terms and conditions contained in this Agreement. This is an important document, which you must consider carefully when choosing whether to use Coincove services.
1. Our Relationship with You.
1.1 Coincove helps you make payments to and accept payments from third parties. Coincove also provides a prepaid debit card to which you can load balances purchased on Coincove.co. Coincove’s service entails the buying and selling of Bitcoin, without exposing you to unnecessary risks involved in dealing with Bitcoins. Coincove uses Bitcoins solely as a money transfer mechanism and does not hold any Bitcoins on your behalf. Coincove is an independent contractor for all purposes. Coincove does not have control of, or liability for, the products or services that are paid for with Coincove services. We do not guarantee the identity of any user or other party or ensure that a third party buyer or seller will complete a transaction. Coincove is not a money transmitter. Coincove assists its users in international money transfers through local Bitcoin transactions.
1.3 Privacy of Others; Marketing. If you receive information about another user through Coincove services, you must keep the information confidential and only use it in connection with Coincove services. You may not disclose or distribute a user's information to a third party or use the information for marketing purposes unless you receive the user's express consent to do so. You may not send unsolicited email to a user through Coincove.
1.4 Intellectual Property. "Coincove.co", "Coincove", and all logos related to Coincove services are either trademarks, or registered marks of Coincove or its licensors.
1.5 Password Security and Keeping Your Email and Address Current. You are responsible for maintaining adequate security and control of any and all IDs, passwords, personal identification numbers (PINs), or any other codes that you use to access Coincove services. You are responsible for keeping your email address and other personal identification information up to date in your Account Profile.
1.6 Notices to You. You agree that Coincove may provide you communications about your Account and Coincove services electronically.
2.1 Eligibility. To be eligible to use Coincove services, you must be at least 18 years old.
2.2 Identity Authentication. If you wish to make any transactions through Coincove, you authorize Coincove, directly or through third parties, to make any inquiries we consider necessary to validate your identity.
2.3 Third Party Applications. If you grant express permission to a third party to connect to your Coincove account, either through the third party's product or through Coincove, you acknowledge that granting permission to a third party to take specific actions on your behalf does not relieve you of any of your responsibilities under this Agreement. Further, you acknowledge and agree that you will not hold Coincove responsible for, and will indemnify Coincove from, any liability arising from the actions or inactions of this third party in connection with the permissions you grant.
2.4 Taxes. It is your responsibility to determine what, if any, taxes apply to the payments you make or receive, and it is your responsibility to collect, report and remit the correct tax to the appropriate tax authority. Coincove is not responsible for determining whether taxes apply to your transaction, or for collecting, reporting or remitting any taxes arising from any transaction.
3.1 Coincove may cancel or reverse potentially high-risk transactions, including those made using reversible payment methods.
3.2 Coincove does not cancel or reverse transactions of Coincove balances between authorized Coincove users, as long as they abide by the stated transfer limits.
3.3 When buying or selling Bitcoins for the purposes of depositing into or withdrawing out of your Coincove balance, you are not buying or selling from Coincove directly. Coincove acts as an intermediary between other buyers and sellers of Bitcoin.
3.4 Coincove reserves the right to change the buy/sell limits on your account as we deem necessary.
4. Restricted Activities.
4.1 Restricted Activities. In connection with your use of Coincove services, other users, and third parties you will not:
5. Disputes with Coincove.
5.1 Indemnification. You agree to indemnify and hold Coincove, its parent, the officers, directors, agents, joint venturers, and employees harmless from any claim or demand (including attorneys’ fees) arising out of your breach of this Agreement or your use of Coincove services.
5.2 Release of Coincove. If you have a dispute with one or more users, you release Coincove (and our parent, officers, directors, agents, joint ventures, employees and suppliers) from any and all Claims, demands and damages (actual and consequential) of every kind and nature arising out of or in any way connected with such disputes. In addition, you waive any protection available to you under California Civil Code §1542, which says: [a] general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if not known by him must have materially affected his settlement with the debtor.
5.3 Disputes with Coincove. If you think we have made an error, please email us at support at Coincove.co. In your correspondence, you must give us information sufficient to identify you, your account, and the transaction on which you believe an error occurred. You must contact us within 30 days after the transaction occurred. Within 90 days of receiving your request, we must either correct the error or explain to you why we believe the transaction was correct.
6. Anti-money laundering procedures.
6.1 Coincove may utilise the services of a third party in order to confirm your identity as part of the registration process.
6.2 Coincove reserves the right to collect identification from you prior to the depositing funds and placement or matching of an order. In general, Coincove collects identification in the form of a copy of a passport/drivers licence and a utility bill showing your current residential address dated within the last three months.
6.3 You should assume all information provided to Coincove is available to regulatory authorities in both the country of origin of the funds, and the destination country of the funds.
6.4 You represent and warrant that the monies transferred to your account with Coincove are not connected in any manner to any unlawful or illegal activity.
6.5 Coincove reserves the right at all times to refuse to process any proposed or matched order which it believes in its sole discretion, is connected in any manner to any unlawful or illegal purpose.
6.6 Coincove is obliged by law to monitor any unusual or suspicious transactions of any size taking place where we have reasons to believe the money is derived from unlawful or illegal activity.
6.7 There is a statutory obligation on all Coincove employees and their agents to report suspicious transactions to the appropriate authorities. Where any such report is made, Coincove accepts no liability for any delay in transmission of or confiscation of the funds.
7.1 You agree to use the Website at your own risk.
7.2 Coincove uses reasonable skill and care in providing its products and services to you. However (to the maximum extent permitted by law) Coincove is not liable to you for any loss, damage, claim or compensation (including loss of profit or loss of use) incurred by you from your use of, or your inability to use, the Website or the products or services offered through or by the Website however caused notwithstanding any error or omission including negligence.
7.4 Time shall not be of the essence for the processing of any transfer. In particular, Coincove accepts no responsibility for any delay in onward payment attributable to the late arrival of your instruction for transfer relative to the cut off times of our bank.
7.5 Coincove shall not be liable for any fees or commissions charged by any intermediary bank or other entity when funds are deposited in your Coincove account or transferred to your personal or beneficiary account.
7.6 Coincove’s maximum aggregate liability to you in respect of all foreign currency transactions undertaken by you shall be limited to a refund equivalent to any monies you have paid to Coincove to acquire foreign currency.
7.7 You agree that Coincove will not be responsible in any way to you or any other person in the event of force majeure or for the act of any Government or legal authority.
7.8 For your protection and that of other users you should not share your registration information (password, User Name, security questions and PIN) with any other person or entity for any purpose. You alone are responsible for all acts or omissions that occur within the Website through the use of your registration information.
7.9 You hereby indemnify and hold blameless Coincove, its directors, officers, employees and agents form and in respect of any loss, damage, liability, cost or expense that it may suffer or incur by reason of you failing to discharge your obligations under or acting in breach of any of these T&Cs or any breach of any applicable law or regulation.
7.10 You shall be responsible for providing and maintaining the means by which you access the Website which may include but is not limited to a computer and a modem or telephone. You shall be responsible for all access, service and ongoing fees necessary to connect to the Website and you shall assume all risks associated with the use and storage of information on your computer or on any other computer through which you will gain access to Website and our services. You agree that Coincove will not be liable in any way to you in the event of failure of or damage or destruction to your computer system, data or records or any part thereof or for any delays, losses, errors or omissions resulting from the failure or mismanagement of any telecommunications or computer equipment or software. You will not expose the website to any viruses, trojans or other similarly harmful or inappropriate material or device. In the event that any such viruses etc. are deemed to have been transmitted to the website from your account Coincove reserves the right to terminate your account and you shall be liable for the cost to Coincove of removing such viruses etc. and Coincove shall have the right to set-off the cost against any balance held to the credit of your Coincove account.
7.11 Coincove is not liable for any viruses for other technologically harmful material that may affect your computer equipment, computer programs or other material resulting from your use of the Website.
8. General Provisions.
8.1 Limitations of Liability. IN NO EVENT SHALL WE, OUR PARENT, THE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES AND SUPPLIERS OF COINCOVE OR OUR PARENT BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR WEBSITE, COINCOVE SERVICES, OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). Some states do not allow the exclusion or limitation of incidental or consequential damages so the above limitation or exclusion may not apply to you. OUR LIABILITY, AND THE LIABILITY OF OUR PARENT, OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE ACTUAL AMOUNT OF DIRECT DAMAGES.
8.2 No Warranty. COINCOVE SERVICES ARE PROVIDED "AS IS" AND WITHOUT ANY REPRESENTATION OF WARRANTY, WHETHER EXPRESS, IMPLIED OR STATUTORY. COINCOVE, OUR PARENT, THE OFFICERS, DIRECTORS, AGENTS, JOINT VENTURERS, EMPLOYEES AND SUPPLIERS OF COINCOVE OR OUR PARENT SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Coincove does not have any control over the products or services that are paid for with Coincove services and Coincove cannot ensure that a buyer or a Seller you are dealing with will actually complete the transaction or is authorized to do so. Coincove does not guarantee continuous, uninterrupted or secure access to any part of Coincove services, and operation of our site may be interfered with by numerous factors outside of our control. Coincove will make reasonable efforts to ensure that requests for electronic debits and credits involving bank accounts, credit cards, and check issuances are processed in a timely manner but Coincove makes no representations or warranties regarding the amount of time needed to complete processing because Coincove services are dependent upon many factors outside of our control, such as delays in the banking system or the U.S. or international mail service. Some states do not allow the disclaimer of implied warranties, so the foregoing disclaimers may not apply to you. This paragraph gives you specific legal rights and you may also have other legal rights that vary from state to state.
8.3 Arbitration. Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under this Agreement shall be finally settled on an individual basis in accordance with the American Arbitration Association's rules for arbitration of consumer-related disputes and you and Coincove hereby expressly waive trial by jury. The arbitration shall take place in San Francisco, California, in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce this Agreement shall be entitled to costs and attorneys’ fees.
8.4 Time Limitation on Claims. You agree that any claim you may have arising out of or related to your relationship with Coincove must be filed within one year after such claim arose; otherwise, your claim is permanently barred.

Personal information(“Personal Information”) is any information about you and may include your name and address, date of birth, bank account details, details of proposed and matched trades and account transfers and any other information you may provide. Once you are registered with Coincove you will use a password to place and fulfill orders and manage your account. A “session cookie” is used to enable you to leave and re-enter our website without re-entering your password. Our web server will record the pages you visit within our website.
To ensure a good quality of service we may monitor and record any communication you have with us whether in writing, by phone or by electronic mail.
Coincove uses persistent cookies to compile relevant user data that assists with business development and third party cookies for website usage analysis. Coincove will use your Personal Information to inform you, from time to time, about relevant products and services. If you do not wish to receive this information you may opt out at any time following the instructions provided in the emails.
Coincove may analyse Personal Information in order to investigate any actual or suspected criminal activity.
We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.
Coincove is obliged under relevant anti-money laundering and prevention of terrorism legislation to retain information relating to personal identity for 7 years following your last transaction with us. Upon expiration of this period Coincove will destroy your Personal Information. Where required by law, your Personal Information may be disclosed to an applicable governmental, regulatory or enforcement authority in the relevant country.
By providing your Personal Information and registering with us or logging on with us when you enter our website, you explicitly consent to Coincove processing and disclosing your Personal Information for the purposes, and otherwise in the manner, set out in this policy, or as otherwise provided in accordance with the Terms and Conditions
